Week 1

Introduction to Fraud and Economic Crime and
Criminal Liability

Aim

In this lecture the participants will be introduced to the concept of fraud and economic crime. They will explore corporate criminal liability and criminal liability of the individual.

After completion of this lecture participants will be able to:

 

  1. Discuss the antecedence of fraud and economic crime.
  2. Apply their considerations to the requisite areas of corporate criminal liability.
  3. Determine the criminal liability of the individual.
  4. Discuss areas of reform in the area of fraud and economic crime.

Week 2

Criminal Law and Procedure and Production of Evidence

Aim

Participants will examine the criminal law process, from the initiating of proceeding through to the admissibility of evidence at trial.

  1. Discuss the Court process from initiation of proceedings through to their conclusion.
  2. Understand the appeals process.
  3. Real Evidence or Hearsay – identifying the difference.
  4. Discuss the admissibility of documents at trial.

Week 3

Fundamental Rights and The Sentencing Procedure

Aim

In this lecture the participants will examine and consider the application of the Irish Constitution and the European Convention on Human Right. The sentencing of corporations and that of individuals.

  1. Understand the fundamental rights incorporated through the Irish Constitution and the European Convention on Human Rights.
  2. Discuss evidential burdens.
  3. Apply the principles of sentencing .
  4. Identify and understand sanctions imposed on both corporations and individuals .

Week 4

Fraudulent and Economic Offences – Part 1

Aim

In this lecture the participants will examine corporate fraud and the various offences that can arise and will examine issues of bribery and corruption.

  1. Identify various offences arising out of corporate fraud.
  2. Understand the constituent elements of offences arising in corporate fraud.
  3. Discuss issues of bribery and corruption.

Week 5

Fraudulent and Economic Offences – Part 2

Aim

In this lecture the participants will examine revenue offences and offences arising from breaches of competition law.

 

Learning Outcomes:

After completion of this lecture participants will be able to:

 

  1. Identify various offences arising out of breaches of revenue legislation.
  2. Understand the powers and investigative techniques of revenue officers.
  3. Identify breaches of competition law and understand the emergence of criminal liability.
  4. Discuss the impact of the European Union within the landscape of competition law.

Week 6

Fraudulent and Economic Offences – Part 3

Aim

In this lecture the participants will examine health and safety offences, investigations and proceedings for breaches. The aspect of corporate manslaughter will also be considered.

  1. Identify various offences arising out of breaches of health and safety legislation .
  2. Discuss the various powers relating to inspections and investigations .
  3. Understand enforcement mechanisms and sanctions.

Week 7

Whistleblowing and Cybercrime

Aim

In this lecture the participants will examine the perception to whistleblowing, and the necessity for protected disclosures. In addition, consideration will be given to the ever-developing landscape of cybercrime.

  1. Understand the necessity for and the nature of a protected disclosures.
  2. Identify when a protected disclosure is not a protected disclosure.
  3. Discuss the ever-developing landscape of cybercrime.
  4. Identify risks posed by cybercrime and ability to take necessary steps to avoid.

Week 8

Companies Act – Compliance and Prosecutions

Aim

In this lecture the participants will examine specific companies act offences, inspection and investigations, enforcement, prosecutions and sanctions.

  1. Identify the various offences under the companies act .
  2. Discuss the various powers of inspection and investigation.
  3. Understand the enforcements, prosecutions and sanctions arising from offending.

Week 9

Criminal Justice (Money Laundering and Terrorist Financing) Act, 2010 – Part 1

 

Aim

In this lecture the participants will examine the Criminal Justice (Money Laundering and Terrorist Financing) Act, 2010.

  1. Discuss the initiatives at national and international level
  2. Identify and understand criminal offences arising from the legislation

Week 10

Criminal Justice (Money Laundering and Terrorist Financing) Act, 2010 – Part 2

 

Aim

In this lecture the participants will examine the Criminal Justice (Money Laundering and Terrorist Financing) Act, 2010.

  1. Identify and discuss the obligations placed on designated persons with respect to anti-money laundering legislation
  2. Understand best practice with respect to record keeping, internal policies, procedures and training

Week 11

The Proceeds of Crime

 

Aim

In this lecture the participants will examine the powers of confiscation, the Criminal Assets Bureau and the Proceeds of Crime Act.

  1. Discuss and understand when the lifting of the corporate veil might occur
  2. Understand powers of confiscation through the various statutes
  3. Identify the powers of the Criminal Assets Bureau

Aim

The purpose of this lecture is to provide participants with a review of the previous 11 lectures and underline the central points of the course.
